The Entertainment Software Association has formally requested that the United States government take action against retro handheld gaming devices pre-loaded with unauthorized software. The organization aims to classify these products as illicit devices that facilitate piracy and counterfeiting.
According to the ESA, these plug-and-play systems should be treated as superfakes, comparable to counterfeit luxury goods. The association notes that while the packaging and websites may appear legitimate, the primary commercial value of these devices relies on internal storage containing hundreds of copyrighted titles.
The ESA further alleges that vendors frequently utilize copyrighted imagery in promotional materials without authorization. This practice misleads consumers into purchasing pirated ROMs, which the organization claims undermines the industry by reducing the demand for legitimate software acquisitions.
Should the United States government initiate an investigation and validate these claims, companies distributing these handhelds could face legal proceedings. Such enforcement would likely result in the mandatory cessation of their business operations.
