The High Court of Justice of Galicia has upheld the dismissal of a cybersecurity manager at Renfe's Digital Competence Center in Monforte de Lemos. The company, through its subsidiary LogiRail, terminated the employee following an investigation into discrepancies between his physical attendance and claimed travel expenses.
During January and February 2025, the employee worked 45 days but only attended the office in person on eight occasions. Despite this, he received mileage compensation for 33 days, resulting in a discrepancy of 25 days compared to his actual physical presence at the facility.
LogiRail justified the firing by stating the employee teleworked beyond authorized limits while collecting travel reimbursements for commutes he did not make. The worker argued that the company was aware of his working conditions and that the payments were standard practice, but the court rejected these claims.
The LogiRail collective agreement mandates that private vehicle travel must be pre-authorized for work purposes. Employees are required to document specific details, including dates, origins, destinations, and total kilometers traveled, to justify such expenses under the company's established regulations.
