On October 15, US Representative Ritchie Torres announced the introduction of the Power To The Players Act. This proposed legislation aims to protect the rights of consumers to own and continue playing the video games they purchase, addressing concerns that digital titles are often provided as revocable licenses rather than permanent property.
The bill seeks to mandate that the Federal Trade Commission establish regulations ensuring consumers can own, play, and transfer their digital games. Representative Torres argues that current practices, where access is dependent on ongoing corporate support, effectively turn sales into rentals. The proposal specifically requires companies to provide offline modes for games with online features before shutting down support servers.
The legislation highlights the case of NBA 2K25, which is scheduled to end digital sales on October 30 and terminate online servers on December 31. While offline modes like Play Now remain accessible, server-dependent features such as MyCareer and MyTEAM will become unavailable, illustrating the limitations of current digital licensing models.
This initiative follows ongoing legal debates regarding digital storefronts and consumer rights, including lawsuits over purchase terminology and international concerns regarding the loss of physical media support. As this is currently a proposal rather than enacted law, the future of digital game ownership remains a subject of significant ongoing discussion.
