The Spanish Horizontal Property Law has established since 2013 that residents may install electric vehicle chargers without requiring explicit permission from their neighbors. This legal framework grants owners the right to proceed with necessary installations even if they involve common areas or structural elements of a parking facility.
A recent conflict in Bizkaia reached the Supreme Court after a resident challenged the installation of electrical conduits through the building's structural floor. While a provincial court initially ordered the removal of the infrastructure, the Supreme Court ultimately ruled in favor of the installers.
The court determined that the modifications were acceptable because the perforations were minimal, adhered to safety standards, and did not negatively impact other property owners. The ruling emphasizes that while individuals own their specific parking spaces, they do not possess absolute control over the surrounding structural components.
This legal precedent confirms that private charger cables can traverse common areas without collective authorization. Such installations are permitted provided they do not compromise the safety or rights of other residents, effectively limiting the ability of neighbors to block these infrastructure improvements.
