The Entertainment Software Association has formally requested that the Office of the United States Trade Representative include the China-based manufacturer Anbernic on its annual Notorious Market List. This list identifies entities that reportedly facilitate substantial copyright piracy or trademark counterfeiting.
The ESA alleges that Anbernic normalizes hardware-based piracy by selling handheld devices preloaded with thousands of unauthorized copies of copyrighted games. These devices allow users to bypass technological protection measures, enabling immediate gameplay without a lawful license or purchase.
According to the trade body, these products function as superfakes that substitute for legitimate sales across multiple console generations. The ESA further warns that such devices pose security and privacy risks, bypass child-safety protections, and shift remediation costs onto publishers.
To combat these issues, the ESA has proposed seven steps for authorities, including inspecting bundled storage media and requiring sellers to substantiate authorization for included content. The association also suggests that governments should coordinate actions against manufacturers and marketplaces that knowingly facilitate the distribution of these illicit products.
